On July 7 and 8 2022 BHVA sent letters to the town of South Bristol claiming code violations by the Fields at BHVA with demands that the town take action. Would the BOD please update the community in writing on the details of this action including:
- How did the town respond to each demand?
- Has there been resolution of the demands?
- Was there an appeal made to the town’s zoning board in regards to the town’s response to these demands?
- How much did this exercise cost BHVA (e.g. There is a $37K entry on a handout at the March 30, 2023 BHVA open meeting for “Municipal Expert for Zoning Hearing”. Also, there were lawyers representing BHVA at the appeal hearing)?
- Is this exercise over?
Here is a summary of the demands:
- Bison - BHVA demands that the Town issue a cease and desist order prohibiting bison on the property immediately.
- Fence on A dock
- Pier - BHVA demands that the Town issue an order for the removal of the fence immediately.
- Commercial Operations - BHVA demands that the Town issue a cease and desist order to stop any and all commercial activities and to remove all equipment and material immediately from anywhere on the premises.

"Over the past few years, we have been assessed a total of $3,700 per ‘home’, not including the latest (2023) assessment. Assuming we have 365 homes in the community, these assessments have totaled $1,350,500. In looking at the Crofton/Kenrick monthly financial reports over the time span of 2019 thru 2022, it appears that roughly another $729,000 has been taken from operating budgets and put into the maintenance reserve bucket. In total, a bit over $2,000,000.
While the monthly income/expense reporting provides good information on day-to-day operational expenses (eg. salaries, utilities, admin fees, insurance), we have never seen any detailed reporting on how the $2,000,000 in reserves were spent.
Is there a chance that we will ever see some sort of accounting on how that money was used? And, given we are now being required to pay another $1,700 per home this year, how will you insure we have a reasonable understanding of how these funds are being spent?”

BHVA BOD,
Please answer the following questions at the March 30th Open meeting,1. The 2022 Budget included $475,000 for "One-time Maintenance Projects". Security System/FOBS ($25,000), Stairs to the Beach ($280,000), Beach Maintenance/Boundaries ($70,000), Common Area Maintenance near Maintenance facility ($100,000). Of these I believe the only one completed in 2022 was the Security System/FOBS This would leave $450,000. Did we spend those dollars on something else? If so, what did we spend it on? If not, have those dollars been rolled over into the 2023 budget?2.The BOD indicated that there was an expense of $100,000 for the delay in the elevator repair. Specifically, what was this expense for and what company did we issue checks to for $100,000?3. Will the BOD provide to the community a spreadsheet for the years 2020,2021 and 2022 showing all law firms we paid, how much we paid them, and what case/legal issue they were working on?4. - Anticipated conclusion date
- Best case outcome for BHVA
The information should be updated monthly.

in the “Explanation and Update of the BHV Budgeting Process” on the Homeowner’s Only section of the BHVA website the following was stated: “The Board must ensure that sufficient cash is available to make payments on contractually defined schedules, like the $253,400 payment for the Pedestrian Bridge, which is due in April 2023, and the $140,000 payment for the Beach Stairs that is to be paid in 3 installments in May, June and July 2023.” Where is this money coming from? The Capital Reserve? Elsewhere? Are these projects on schedule?

Is the BHVA BOD trying to get the town to shutdown the kayak rack rental business currently available on the Fields property by the beach? If yes, why?
