The following questions have been submitted to the BHVA BOD for the upcoming board meeting November 10,2022:

Question: The BHVA BOD just made an appeal to the town of South Bristol Zoning Board about some BHVA complaints against the Fields that were addressed in a letter from the town’s Code Enforcement Officer.  What were the board’s appeals, what are the actual/anticipated legal fees for this appeal, what was the outcome of the appeal, will this information be shared with the community, what is next with this appeal.

Question: When Crofton was our property manager our website had a homeowners only section where financials, meeting minutes etc were available for viewing. Are there any plans to provide this on the Kenrick BHVA website? If not, how do we initiate a project to look into providing this information.

Legal:

We as a community have expended many dollars for legal services over the past 3 years. Who were the law firms and how much did we pay each of them? For each of the law firms we paid, what was the legal case they billed us for? Please supply this information for each year, 2020, 2021 and current year 2022.

 

Field fines:

I have seen a letter to Fields from the town of South Bristol along with a map clearly stating that their Shore Drive parcel is not part of our Planned Unit Development. Does our BOD have documents that dispute this?

In these very hard financial times we need to know how our money is being spent.  The management company Kendric,and the BHVA has been very secretive and not open or transparent. How much money has been spent on legal funds in the last three years.  How many law firms are we employing and what are the goals for conclusion,and when will the community have a vote in the settlement proposals or negotiations?

"In the past, the minutes from BHVA Board meetings were made available electronically to community members via the property management website.  This was an excellent and efficient method of communication. 

Since this means is no longer used, what is the current method for residents to access the minutes from any BHVA Board meeting where a quorum of members are present and BHVA business is conducted?"

Clearly what BHVA financials presented to date show feverish spending on legal fees with little end in sight.  This is no longer sustainable. 

 

1.    Does the board still believe that this is majority wishes of our community? 

 

2.    Are current and past board members aware that our BHVA by-laws state they may be personally liable as individuals if found that they violated their fiduciary responsibility to our community?

 

3.    Other than Erie Insurance what other insurance agencies to date are providing coverage to BHVA Directors and Officers and what annual cost? 

 

4.    Are there areas where the insurance company won’t insure the board?  What are the deductibles for claims?

I am requesting that the following questions be submitted for the upcoming community meeting:

Q #1:  For the first half of this year, we were provided with a monthly balance sheet as well as an income/expense statement.  There was no information provided for July or August, and the September report only showed a balance statement.  Why the gaps?  And, from here on out, what can we expect to see?

Q #2:  We have been assessed thousands of dollars these past couple years, but do not have visibility as to how much of those 'funds' have been spent, and on what.  Are there any plans to provide this information?  If yes, when?  If no, why not?

There were two lawyers representing the BHVA interests at the Zoning Board of Appeals’ Meeting at the South Bristol Town Hall.

1.    Who were those lawyers and from what firm?

2.    Was their payment covered by our insurance company?

3.    What was the cost?

There was an additional lawyer representing the BHVA at the Field’s hearing with the BHVA BOD on Thursday October 20.2022.

1.    Since the elevator has been closed several weeks ago, what progress has been made on the bridge? It does not appear as though any progress has been made.

 

2.    Have you determined the cost of repair of the steps to the beach?  When will this work be taking place?

 

3.    NYS law provides homeowners the right to access invoices, ledgers, bank accounts, reconciliations, contracts and any other document related to the expenditure of homeowners’ association’s dues at every meeting on a monthly basis. Why is this not being done?  What do we need to do to make that happen?

1.    Why are the fobs (and codes at the elevator) being replaced with a card system?
